Terms and Policies

These Terms and Policies apply to photographs, digital downloads, prints, galleries, and photography services provided by McKanna Photography.

Image Use and Licensing

All photographs created by McKanna Photography are protected by copyright and remain the intellectual property of McKanna Photography unless otherwise agreed to in writing.

Purchasing, receiving, or lawfully downloading an image grants the recipient a personal-use license. Copyright ownership is not transferred.

Personal Use

Unless otherwise agreed, you may:

Download and save delivered images for personal use
Print images for personal use
Share images with friends and family
Post images on personal social media accounts
Use images as personal profile or cover photos
Crop or resize images as reasonably necessary for personal social-media use

Credit to McKanna Photography when sharing online is appreciated but is not required unless otherwise agreed.

Prohibited Uses

Unless written permission or an appropriate license has been granted, you may not:

Sell, sublicense, or redistribute image files
Use images for advertising, marketing, fundraising, sponsorship, merchandise, or other commercial or promotional purposes
Use images on behalf of a business, organization, publication, school, team, or other entity
Enter images into photography contests or otherwise represent the photographs as your own work
Remove watermarks from preview or proof images
Apply filters or substantially alter the color, composition, or appearance of an image
Add or remove significant elements from an image
Use artificial intelligence or generative editing tools to substantially modify an image
Use an image in a way that falsely represents or mischaracterizes the original photograph or its subject

Businesses, organizations, publications, schools, teams, nonprofits, and other entities wishing to use photographs for promotional, editorial, marketing, advertising, publication, or other non-personal purposes should contact McKanna Photography for permission or licensing.

Copyright and Likeness Rights

McKanna Photography's ownership of the copyright in an image does not override applicable privacy, publicity, model-release, venue, school, event, or other legal requirements concerning the people or property depicted.

Where additional authorization is required for a particular use, appropriate permission must be obtained before that use.

Editing and RAW Files

Delivered photographs represent the final edited work of McKanna Photography.

RAW files, unedited photographs, rejected images, and other working files are not provided unless specifically agreed to in writing.

McKanna Photography retains discretion over image selection, editing style, color treatment, cropping, and other creative decisions consistent with the service provided.

Digital Purchases and Delivery

Digital images are delivered electronically through an online gallery, download service, or another agreed delivery method.

Customers are responsible for downloading and safely backing up purchased or delivered files.

Online galleries are provided as a delivery and viewing service and should not be considered permanent image storage. Galleries may expire, be archived, or be removed after delivery.

McKanna Photography does not guarantee indefinite availability of previously delivered files.

Prints and Physical Products

Prints and other physical products may be fulfilled by a third-party professional lab.

Colors, brightness, cropping, and other characteristics of a physical print may vary slightly from how an image appears on a particular screen or device.

Orders for physical products generally cannot be canceled or changed once they have entered production.

If an order arrives damaged, contains a production defect, or is materially different from what was ordered, please contact McKanna Photography so the issue can be reviewed and, when appropriate, corrected or replaced.

Refunds and Final Sales

Because digital photographs cannot practically be returned once delivered, digital image sales are generally final after the files have been made available for download.

Custom print and product orders are generally final once submitted for production.

Nothing in this policy prevents McKanna Photography from correcting an incorrect order, replacing a defective product, resolving a failed delivery, or providing another appropriate remedy when circumstances warrant it.

Any cancellation, refund, rescheduling, or deposit terms applying to commissioned photography services are governed by the applicable photography agreement or booking terms.

Photography Services

Photography involves real people, events, locations, lighting, weather, schedules, access restrictions, and other conditions that may change or fall outside the photographer's control.

McKanna Photography will make reasonable efforts to provide quality coverage consistent with the service booked. However, no specific pose, expression, moment, participant, background, lighting condition, or individual photograph can be guaranteed unless specifically agreed to in writing.

The number of final photographs delivered may vary depending on the event, session, conditions, and service purchased.

Event Photography

Event galleries are intended to provide photographic coverage of an event and do not guarantee that every attendee, participant, performer, group, or moment will be photographed.

The presence of photographs from an event does not by itself indicate that the event organizer, venue, school, team, or other organization sponsors, endorses, or is affiliated with McKanna Photography.

Event photographs may be removed from sale, publication, or public display when reasonably appropriate or when required by an event organizer, applicable agreement, or law.

Purchasing or downloading an event photograph provides only the license described in these terms and does not grant commercial, publication, merchandising, or promotional rights.

Portfolio and Promotional Use

McKanna Photography may display photographs in portfolios, on its website, on social media, in sample products, or in other promotional materials only where such use is permitted by the applicable client agreement, release, event arrangement, or other authorization.

Additional considerations may apply to photographs involving minors, private events, schools, or other circumstances in which permission or restrictions apply.

Limitation of Liability

To the extent permitted by applicable law, McKanna Photography is not responsible for indirect, incidental, special, or consequential damages arising from the use of photographs, galleries, products, or services.

To the extent permitted by applicable law, McKanna Photography's total liability relating to a purchased product or photography service will not exceed the amount paid for the applicable product or service.

Nothing in these terms limits rights or remedies that cannot legally be limited or waived.

Third-Party Services

McKanna Photography may use third-party services for website hosting, gallery delivery, payment processing, printing, file storage, or other business functions.

Use of those services may also be subject to the applicable provider's terms and policies.
